Brampton Child Homeless--Bank Perpetuated Mortgage Fraud

We are a Canadian family who needs your help. This can and will happen to you or someone you love if you let it happen to one person/family (ie. us). We are mortgage/title/equity fraud victims and now victims of bank(s) that pulled a terrible and dirty trick to make us lose our home and be homeless! CIBC Bank staged a "ghost lawyer" to act on our behalf only to benefit CIBC in obtaining a fraudulent judgment to take our home and force us on to the street. We had no idea of any court date or any threats to take our home away. This ghost lawyer has since come forward in a fax and stated he never corresponded with the bank--this fax clearly puts the legal judgment placed on our home and obtained in favour of CIBC as being fraudulent! (CIBC is the bank for President's Choice Bank; the latter is responsible for giving that mortgage out fraudulently without due dilligence.)

If the bank can take our home away using a terribly unfair judgment, then what next? Who is next? Our family is homeless and our lives all but destroyed as a result of CIBC's actions. We have no one else to turn to. This is our family's first grassroots plea to get help from the public. Please don't let us down!

In trying to fight CIBC, the bank continues to unleash their punishment on us. The bank just last week removed our personal belongings and damaged them without even informing us in advance of their actions. As a result, our daughter went into deep depression and shock when she went with her dad to check on our family home, the only home she's ever known. She was frustrated and in tears when she saw her toys broken and strewn all over, and in the driveway as she and her dad helplessly watched the mover's trucks drive away with our family belongings. Our child has always kept her toys in excellent shape. She valued each and every present or toy she received; when she was done playing with her toys, she would neatly put them away in the closet. She was devastated when she saw her bedroom desk torn apart in the living room of the house--she couldn't believe they could destroy her life with such cruelty and disregard.

Our baby was as shocked as we were; we always took pride in how we cared for our home, which we long ago decided would be our last and final home, and we never imagined our dream home would be taken from us and damaged while we helplessly watched. The rain drainage system our child proudly helped install with her dad was ripped off the house. The plants our child carefully watered and hung were all destroyed and thrown around. Imagine being 12 and seeing the bank do this to your family, your pets, and your toys! Imagine being 12 and having an illness all your life, forcing you to be home educated, and then having every memory of your home education destroyed. Everything she did from watering the plants to putting a screw in the rain drainage system was made a part of her learning projects. Now her memories, her education, her efforts--all destroyed by the bank! If she learns one thing from this, it's that as a family we have integrity and are prepared to fight the bank with proof we were defrauded--the bank's judgment against us was won using a lie.

We are trying desperately to keep our family and our two pups together. Our child's medical illness and her very existence has been conveniently excluded by the bank from their paperwork, for their benefit. Our daughter has always been home educated due to illness, despite which the bank forced us out of our home without acknowledging her as an occupant. We have always maintained our home to a standard where our child's illness was manageable--now this summer she had endured several severe medical attacks since being homeless! If that wasn't bad enough, she was also bullied by kids in the neighbourhood because they had no idea what actually took place. What was once our very sweet, innocent, and loving child, it's so sad to see her become bitter, angry, and disillusioned. And now she is going through horrible states of depression and rage, all without any hope of help from others except from a neighbour and his family who cares, and have been standing by our side.

As previously alluded, the bank gave out a fraudulent mortgage on our family home without our knowledge. The bank took us to court without first informing us of a court date and as a result, took our home through an unfair judgment in Oct 2006, with the aid of the aforementioned "ghost lawyer." Bank's law firm signed affidavits stating this ghost lawyer existed, was acting on our behalf, and had communicated with them; these were verbal communications, never in writing--NOTHING ON PAPER! The bank staged all this to steal our home. Prior to the court date (which was unbeknownst to us), the bank made us believe that we were not held responsible. Our family and others believed the bank when they called our home in August 2006 and told us that they (bank) were not holding us responsible for the fraudulent mortgage. At the time, we cried tears of happiness and tried desperately to rebuild our lives, trying to find peace after we were sure this horrible episode was over. Now we know we had been tricked by the bank.

In late January 2007, we were shocked to learn that there was an October 2006 court date where the judge awarded the bank our home in our absence, which led to us being evicted. We have since located this "ghost lawyer," and he replied to our fax stating that he never went on record, and never corresponded with the bank and their law firm. We now have proof the bank did not do due diligence in giving out the fraudulent mortgage, and in trying to cover their tracks, have also committied fraud against us (via their "ghost" lawyer.

We are a small family with a young child. Please help us. Writing this letter has not been easy, so please understand we are all depressed and deeply affected by being homeless and destitute with our lives destroyed. We have many times thought life was no longer worth living, but for our daughter's (and our pups) sake we are not ready to give up.

Note: We have had several neighbours witness the injustices we have gone through. In our initial meetings in late July 2007 with a new and highly recommended lawyer, this lawyer was all gung ho and ready to fight CIBC (and their "ghost" lawyer) and have our fraudulent mortgage removed and judgment set aside. However, not even two weeks later, and after getting paid his retainer, this same lawyer never even bother to return our numerous calls, faxes, or emails for nearly a month!!! We, and others feel CIBC may have influenced him to back down and not fight them. In the absence of any action on this lawyer's part, CIBC was able to walk in and empty our house of all our contents without first informing us. And to add insult to injury, once we finally got a hold of this lawyer last week, we were shocked to find he had done a complete 180 turn and now believed the bank, telling us our case against the bank would be weak because we had unknowingly made payments against the fraudulent mortgage in order to protect our home (this was done under advise from our prior lawyer). Now, he indicated to us to just accept everything and get a new mortgage; this was precisely what he forbid us from doing at the outset when we'd come to him to ask him to sign off on a new mortgage!

There is a strong conspiracy here by those entities much more powerful than us, who want to bury us dead or alive, and we deperately need your help. Now that the house has been emptied, we have been warned that the bank can SELL IT at any moment.

We need you to forward this email to your friends (and especially to people of influence) within Ontario to get the word out regarding this fraud. The Ontario government has recently passed a law (Dec 2006) to protect mortgage fraud victims, but this law has done nothing for us. We need your help to get us back into our home so we can finally start rebuilding our lives, and our daughter can once again regain her sweet and loving nature.
